MULAY Basketball, including the services available through the websites mulaybasketball.club and mulaysport.com and the MULAY web app (the installable version of those websites), is operated by Laundrix Computer Programming Services, with business address at Tacloban City, Philippines (the full registered address is given on request by email).
In these Terms, “MULAY,” “we,” “us,” and “our” refer to that operator. “User” includes a player, parent or guardian, team representative, host, coach, organiser, or other person using the service.
These Terms govern access to the platform and the platform-related arrangements between MULAY and its users. Event-specific agreements may separately govern participation between a participant and an independent organiser.
By affirmatively accepting these Terms during registration or another applicable transaction, you agree to be bound by them. Material provisions concerning payment, cancellation, participation risks, and personal information must be presented before the relevant commitment.
If you do not agree, do not create an account or enter a new booking through the platform.
Nothing in these Terms removes rights or obligations that Philippine law does not permit the parties to exclude.
MULAY provides tools that may allow users to discover basketball games, tournaments, clinics, venues, coaches, and related activities; make reservations; receive announcements; and maintain relevant participation records.
Unless an event expressly identifies MULAY as its organiser, events listed on the platform are organised and delivered by independent hosts, coaches, venue operators, or other identified providers.
For independently organised events, the organiser is responsible for matters within its control, including:
An organiser’s listing on MULAY does not, by itself, make that organiser an employee, partner, agent, or representative authorised to bind MULAY.
The parties’ actual conduct and applicable law determine their legal responsibilities. This section does not exclude responsibilities that MULAY itself undertakes or is required by law to perform.
MULAY may require identity, business, qualification, or other verification information from hosts and coaches.
A verification label means only that the particular checks described by MULAY were completed. It is not a guarantee of competence, medical suitability, character, insurance coverage, venue safety, or the absence of risk.
Hosts and coaches must not describe a verification label as government accreditation, professional licensing, or a safety certification unless that description is accurate and independently supported.
Users should review the organiser’s identity, event details, qualifications, venue, cancellation terms, and relevant safety arrangements before booking.
Individual account holders must be at least 18 years old and legally capable of entering the relevant agreement.
Participants under 18 may be registered only through an authorised parent or legal guardian using an adult account and the appropriate minor-registration process.
You must:
You are responsible for activity you authorise through your account. Responsibility for unauthorised activity will be assessed according to the circumstances and applicable law; it is not automatically imposed on you merely because your account was involved.
MULAY may request proportionate verification when reasonably necessary for security, safeguarding, transaction integrity, or legal compliance.
Before confirming a booking or making payment, review:
A reservation is confirmed only through the confirmation process identified for that event.
Hosts must disclose material conditions before accepting payment. Conditions introduced afterward do not automatically bind a participant who has not agreed to them.
Users must not make fraudulent, speculative, duplicate, or intentionally misleading reservations.
Unless the relevant transaction expressly states otherwise, players pay event fees directly to the identified host or coach.
For those direct-payment transactions, MULAY does not receive, hold, or control the participant’s event payment. The recipient is responsible for acknowledging payment, maintaining appropriate records, and fulfilling applicable refund obligations.
Hosts and coaches may separately pay platform fees to MULAY. The amount, payment schedule, and applicable cancellation conditions must be disclosed before the host accepts the relevant service.
A platform fee does not purchase immunity from complaints, moderation, suspension, or legal obligations.
MULAY will not represent that it can reverse or refund money it does not control. It may assist with records, communications, and complaint handling without guaranteeing a particular outcome.
These arrangements do not exclude any responsibility imposed on MULAY by applicable law.
The cancellation policy disclosed before booking applies, subject to mandatory law.
A clearly disclosed policy may provide that a participant who voluntarily cancels or fails to attend forfeits the event fee. However, that provision does not excuse an organiser’s failure to provide the promised service or override a refund right available under law.
If an organiser cancels an event without providing the booked service, the participant is entitled to a refund of the amount attributable to that unprovided service, subject to applicable law.
A credit or transfer to another event may be offered but must not replace a required refund without the participant’s agreement.
If an organiser changes the event to a different date, materially changes the venue, or substantially changes the promised service, the participant may decline the changed arrangement and request the applicable refund.
The organiser must acknowledge a refund request promptly and process an approved or legally required refund within 7 calendar days, unless a shorter legal period applies.
Organisers must not impose undisclosed deductions. Any permitted deduction must have a lawful and clearly disclosed basis.
Refunds are ordinarily made by the payment recipient through a reasonably verifiable method. MULAY may record the request and outcome but does not thereby become the holder of the funds.
No provision prevents a user from approaching a payment provider, regulator, or competent court.
Basketball and related physical activities involve inherent risks. Depending on the activity, these may include physical contact, falls, collisions, sprains, fractures, head injuries, heat-related illness, sudden medical emergencies, permanent disability, or death.
Acknowledging these risks does not establish that every injury is unavoidable or that negligent conduct is acceptable.
Each participant must:
A participant should not continue merely because an organiser or another player encourages them to do so.
MULAY does not provide medical diagnosis or fitness clearance through ordinary platform registration.
For an independently organised event, the organiser, venue operator, coach, participant, and other involved persons remain responsible for their own acts and omissions to the extent provided by law.
MULAY does not accept responsibility merely because an event was discovered, advertised, reserved, or discussed through its platform. A claim must have an applicable factual and legal basis.
To the extent permitted by law, a participant accepts the ordinary inherent risks of lawful participation that remain despite reasonable precautions.
This acknowledgment does not waive liability for fraud, wilful misconduct, gross negligence, legally non-excludable negligence, breach of a mandatory duty, or another liability that cannot lawfully be waived.
Nothing in these Terms:
Any separate event waiver must be consistent with these limits.
Hosts must establish arrangements appropriate to their event, including emergency contact procedures, access for emergency responders, and reasonable first-response measures.
If an emergency occurs, the host should contact emergency services and the appropriate parent, guardian, or emergency contact as circumstances require.
Where a participant cannot communicate, persons assisting may seek urgent professional help in accordance with applicable law and the circumstances. Platform acceptance is not a blanket consent to any medical procedure.
Medical, ambulance, and related expenses remain payable by the person legally responsible for them. This clause does not decide who caused an incident or prevent recovery of expenses from a legally responsible party.
A parent or legal guardian registering a minor must provide accurate information, disclose relevant participation needs through the designated process, and comply with reasonable arrival and authorised-pickup procedures.
An organiser accepting minors must provide appropriate supervision and safeguarding arrangements, including clear responsibility for check-in, attendance, emergency contact, and release to an authorised adult.
Guardian permission to participate is not a blanket waiver of the child’s legal rights.
Permission for:
must be addressed separately where required. Participation must not automatically authorise unrestricted commercial use of a child’s image or personal information.
Hosts and coaches must:
Hosts must not use participant contact information for unrelated marketing, public posting, or disclosure to other organisers without an appropriate lawful basis.
MULAY may require additional written host conditions before allowing an organiser to list events.
Users must not engage in:
Criticism and genuine complaints are permitted. Users must not fabricate allegations or use threats to obtain an improper benefit.
You retain ownership of content you lawfully upload.
You grant MULAY a non-exclusive licence to store, reproduce, format, and display that content only as reasonably necessary to operate the feature through which it was submitted, consistent with your selections and the Privacy Notice.
Separate permission is required for materially different promotional uses where applicable. Uploading content is not an unrestricted transfer of ownership or a blanket consent from everyone shown.
You must have the necessary rights and permissions, particularly for identifiable minors.
MULAY may review, restrict, remove, or decline content for legal, privacy, safeguarding, or community-rule reasons. Moderation is not a guarantee that every unlawful or harmful item will be identified before publication.
A person requesting removal should identify the content and explain the relevant concern.
Report platform concerns to support@mulaysport.com. Include the event, organiser, date, relevant transaction details, and supporting records where available.
Do not email unnecessary medical records or full identity documents unless MULAY requests them through an appropriate channel.
For immediate danger, contact emergency services or the appropriate authorities first.
MULAY may preserve relevant records, request responses, restrict a listing, or suspend access while reviewing a credible safety or legal concern. It does not act as a court or promise to resolve every dispute.
MULAY may restrict or suspend access where reasonably necessary to address a material breach, fraud, safeguarding concern, security threat, unpaid platform obligation, or legal requirement.
Where appropriate and lawful, MULAY will explain the reason and provide an opportunity to respond. Immediate action may be taken when delay would create a material risk.
Suspension does not automatically eliminate a valid refund claim or permit confiscation of money held for services not provided.
MULAY will use reasonable care in providing the platform but does not promise uninterrupted availability, error-free operation, or compatibility with every device.
To the extent permitted by law, MULAY is not responsible for losses caused solely by an independent organiser’s breach, a user’s unauthorised conduct, or a third-party failure outside MULAY’s responsibility.
For legally limitable claims arising solely from ordinary platform-service defects, MULAY excludes indirect or consequential losses to the extent that exclusion is lawful and fairly applicable.
No exclusion or limitation in these Terms applies where it would unlawfully restrict liability for personal injury or death, fraud, wilful misconduct, gross negligence, a mandatory consumer or privacy obligation, or another non-excludable liability.
MULAY remains responsible for amounts it is legally required to refund or pay.
A host, coach, or business organiser must reimburse MULAY for reasonable, documented losses and defence costs finally determined to arise from that organiser’s unlawful conduct, material contractual breach, or culpable acts or omissions.
This obligation applies only to the extent of that organiser’s legal responsibility. It does not require reimbursement for MULAY’s own fault or transfer a non-transferable statutory obligation.
MULAY must give reasonable notice of a covered claim and an appropriate opportunity to participate in its defence. No settlement imposing an admission or non-monetary obligation on the organiser may be entered without consent, not to be unreasonably withheld.
Severe weather, disasters, government restrictions, utility failures, or other qualifying events may affect service delivery.
An affected party must take reasonable mitigation measures and communicate material changes promptly.
This section does not automatically excuse a failure to address a known hazard, return money when legally required, or perform an obligation that could reasonably still be performed.
Philippine law governs these Terms, subject to mandatory rules applicable to a particular transaction.
The parties should first attempt good-faith resolution through the contact process. This does not prevent urgent relief, regulatory complaints, or proceedings required to protect a legal right.
Court venue and jurisdiction will be determined under applicable law. Nothing requires a user to surrender a mandatory consumer remedy.
Material amendments apply prospectively. MULAY will provide appropriate notice and obtain renewed acceptance where required. Changes do not retrospectively remove accrued rights or alter a completed transaction without a lawful basis.
If one provision is unenforceable, the remaining provisions continue insofar as they can fairly and lawfully operate.
Advertisers pay MULAY the price per day shown on the Advertise page. Advertisements are labelled Sponsored, are reviewed before they appear, and may be removed for legal, safety or community-rule reasons. MULAY does not endorse an advertiser or its products.
Spectator tickets for a tournament are sold for the organiser, who is responsible for the event and its entry rules. Buyers pay the organiser directly and MULAY never holds ticket money. The service fee, if any, is shown before purchase. A ticket for an event that is cancelled or materially changed follows section 7.
